Residential and commercial leases are legally binding agreements where possession and ownership are bifurcated. The owner of a piece of real estate or real property agrees to allow another person or entity to possess and use the space for a specified period of time. Leases are drafted for both commercial and residential property and different issues apply depending on the type of lease you are entering into. When you enter into a residential or commercial lease, key issues to negotiate include the length of the lease, the rent to be paid and the division of responsibility for paying the cost of utilities and/or for repairs to the property. In commercial leases, other issues arise such as restrictions on leasing to competitors and requirements for lease renewals, especially if the leasee is to invest funds in preparing the office space.
