A lease establishes obligations for both landlord and tenant. In a commercial lease, there are a number of issues that arise that do not exist in a standard residential lease. In addition to rent, maintenance and operating costs, for example, the lease may address leaseholder improvements, restrictions on leasing to competitors, details about payment for utilities and taxes, apportionment of liability, and renewal terms.

A decision must initially be made on the type of lease that will be entered into (for instance, a triple net lease is one where the tenant is responsible for the property, utilities and taxes). Once the type of lease is determined, each of the lease terms must be negotiated. The final lease document should be carefully reviewed by a legal professional to ensure that the signing party’s interests are fully protected.
